Rules and Regulations: Charter Party shall at all times observe and enforce the following rules and regulations. Each person has to adhere to the following: All guests on the party vehicle must be 21 or older to drink alcoholic beverages. 1. Each passenger must have a valid state issued ID or driver license. NO Exceptions! If you do not have a valid ID you will not be allowed to participate on the bar tour. Your ticket price will not be refunded. 2. Absolutely no drugs, no gangs, no gang signs, no violence, no obscenity, no weapons of any kind will be allowed. If any of the above occurs regardless of location, you and your party will be immediately dropped off and ushered to a taxi or not allowed back on the vehicle, Police will be notified. You will not be refunded any portion of fees paid or to be paid. You will be responsible for the taxi and all damages to Mile High Club~N, Inc.’s vehicles will be charged to your credit card immediately. All receipts are available for the customers’ review upon request. Damages shall include all towing charges, court costs and attorneys fees. 3. Mile High Club~N, Inc. will drop you off safely at the pre-arranged location at the end of the trip. We do not promote drinking and driving and you should not drive home if you have been drinking. Mile High Club~N, Inc. recommends that you spend the night at Hotel VQ which offers discounted rates for passengers. It also can call taxi services available for you. Please let us know if you’ll be spending the night or how you’re getting home. 4. If any Mile High Club~N, Inc.’s vehicle is stolen by you or one of your guests, you will be held liable for replacement costs, collection fees, attorneys fees and court costs, etc. Your credit card will be charged for full replacement cost. The general manager will be contacting you to discuss the charges the following business day. If the item can be repaired at no or nominal cost the amount so charged will be credited to your credit card. 5. While the vehicle is in motion, please keep one hand holding a rail while standing, for your safety. No standing on the seats, sitting on the seat rails. No standing or sitting on the coolers and counters, please do not hang on the hand rails. 6. All injuries must be reported immediately at the time of injury to Mile High Club~N, Inc. 7. I AGREE TO DRINK RESPONSIBLY. All Mile High Club~N, Inc.’s staff, all participating venues and drivers have a right to immediately cancel your participation due to intoxication. You will be dismissed from the event, ushered to a taxi and sent home at your expense. 8. No Nudity will be allowed on board the vehicle. 9. No food of any kind shall be brought on Mile High Club~N, Inc.’s vehicle, except for that furnished, if any, by Mile High Club~N, Inc. 10. No smoking in the vehicle. If you must smoke please stay 15 feet away from the vehicle doorway. 11. At no time may trash be thrown out windows or doors. 12. If any member of the charter party’s participants should vomit on the vehicle it will be charged a $250 fee for cleaning. No exceptions! Please drink responsibly. This amount will be charged to your credit card unless paid in cash to the driver and the person will not be allowed back on the vehicle. 13. If any body fluids should be discharged while on the vehicle there will an additional $250 fee for cleaning. This charge will be made to your credit card unless paid to the driver in cash. We want the Mile High Club~N, Inc. vehicle to continue to look great for all our customers. 14. Mile High Club~N, Inc. will not be responsible for the lateness of any charter party participant. It is your responsibility to show up on time or contact us at the hotline 303-936-CLBN so we can try possibly to accommodate a need for a short delay. If you do not load at the vehicle at the specific times you will be left at the venue/club and it will be your responsibility to get home. Your ticket price will not be refunded. 15 Pictures and\or videos taken by Mile High Club~N, Inc.’s Staff may be used in advertising, flyers, television, Mile High Club~N, Inc.’s website, or similar uses. The charter party, for itself and its participants, expressly waives any rights not to be photographed and any resulting images shall be the sole and exclusive property of Mile High Club~N, Inc. operated equipment might be subject to temporary failure. This will of course not interfere with the safety of 1. $30.00 per broken glassware 2. $30.00 missing glassware, ice bucket, ice scoop. 3. $350.00 per damaged DVD player 4. $200.00 minimum for extensive cleanup (spills,etc.) 5. $250.00 detailing and wax (due to sickness-exterior) 6. $250.00 shampoo and disinfecting (due to sickness-interior) 7. $200.00 minimum for each burn hole, rip or tear to upholstery 8. $200.00 minimum for each act of vandalism 9. Triple charge of above listed amounts for all removed / stolen items from vehicle 10. $500.00 and up for TV or any other electronic equipment. TERMS AND CONDITIONS 1. Seating and Safety are top priority to both you and Mile High Club~N, Inc. We ask that all charter members remain seated at all times. Total number of passengers cannot exceed seating capacity of coach. Charter groups must provide adequate supervision and discipline. Sole responsibility for monitoring and supervising the passengers rests with the charter group members and their leader. Mile High Club~N, Inc. undertakes and assumes no responsibility for the conduct or actions of the charter group members. For your SAFETY, your drivers must devote their full attention to driving. 2. Alcoholic Beverages: You must be 21 years of age. NO EXCEPTIONS. Trips which include the use of alcoholic beverages in the passenger area of the coach must be approved prior to departure. No glass bottles, No kegs with tappers or coolers are allowed in passenger area. In the event the coach is damaged or requires unusual cleaning and you did not pay a security deposit you will be required to pay the driver at the time of the inciden due to the use of alcoholic beverages. Otherwise; the security deposit will be applied to the cost of repair or cleaning; however, notwithstanding application of the security deposit to the foregoing, the total cost of repair or cleaning of the vehicle caused by the actions of the charter party will be charged to the charter party by the carrier. Security deposit returns are processed through management after the trip completion. Sole responsibility for monitoring and supervising the passengers rests with the charter group members and their leader. Mile High Club~N, Inc. undertakes and assumes no responsibility for the conduct or actions of the charter group members. Alcoholic beverages will not be allowed under any circumstances when any passenger is 20 years or younger. 3. Personal Belongings and Baggage: We will handle such items only at the owner’s risk and only to the vehicle’s safe maximum capacity to accommodate luggage. The carrier is not responsible for personal items, or baggage and its contents which are lost, stolen, left on the vehicle or damaged by any cause or in any manner whatsoever. 4. Liability: 1) The carrier will not be liable for delays caused by an act of God; public enemies, authority of law, quarantine, perils of navigation, riots, strikes, the hazards to danger incident to a state of war, accidents, breakdowns, poor conditions of the road, snow storms, and other conditions beyond its control, and does not guarantee to arrive at or depart from any point at a specified time. The carrier will endeavor to maintain the schedule submitted by its agent or employee, but is not guaranteed; 2) If any act of God, the public enemy, authority of law, quarantine, perils of navigation, riots, strikes, the hazards of damage incident to a state of war, accidents, breakdowns, poor conditions of the road, snow storms, and other conditions beyond its control, make it in the opinion of Mile High Club~N, Inc. inadvisable to operate either from the place of origin or any point en route, it shall not be liable for cessation of service or to be held liable for damages for any reason whatsoever. 5. Video Policy-Copyright and other intellectual property obligations: The charter party, pursuant to the copyright laws of the United States and other applicable laws, including all international copyright laws, treaties and conventions, shall obtain from the owners, their agents or other licensor of the copyright and other intellectual property rights, all licenses and other grants and permissions necessary for public performance of all music, other audio and visual materials presented or sponsored by the charter party on the leased vehicle, and shall make all required royalty license and any other payments which may be required. To the extent, if any, that Mile High Club~N, Inc shall be required to obtain any such licenses, grants and permissions and/or to make royalty, license or any other payments as a result, the charter party shall pay for or reimburse to Mile High Club~N, Inc. the full cost, including taxes and administrative fees, if any, of such payments. 6. Indemnification: party indemnifies and holds harmless Mile High Club~N, Inc.and its officers, directors, agents and employees, and each of them from and against any and all actions, causes of action, claims, demands, liabilities, losses, damages, costs or expenses of whatever kind and nature, including judgments, interest and attorneys’ fees which Mile High Club~N, Inc. shall or may at any time, or from time to time, subsequent to the date of this agreement, sustain or incur, or become subject to, involving, with respect to or relating to 1) any breach by the charter party of any provision of this agreement or any other contract with Mile High Club~N, Inc., 2) any actions of omissions of Mile High Club~N, Inc. resulting from or related to the performance of the services contemplated hereunder whether arising in contract or tort or otherwise and whether or not caused by the negligent action of Mile High Club~N, Inc. or that of any third party; or 3) the infringement or alleged infringement of any copyright, trademark or other proprietary rights of others. 7. Participating clubs may change without notice; if you book a tour you will be notified whether the club is still a participating venue.
